Terms of Service & Observation-Only Policy

Effective October 13, 2026 · Version 2026-10-13.2

What FergAir provides

FergAir provides educational resources, local business research, and outreach assistance within an agreed scope. FergAir is not the host facility, a maintenance training provider, or a supervisor of aircraft work. Business listings do not establish an endorsement, a safety certification, or a confirmed opportunity. FergAir does not guarantee a response, visit, job, or certification.

Strictly observation only

FergAir job-shadow referrals are observation only. Do not touch any aircraft, cockpit controls, systems, parts, or components, and do not perform or assist with maintenance—even if someone at the facility invites you to help.

  • Watch and ask questions from the area designated by your host. Keep your hands off aircraft and anything in or attached to an aircraft.
  • Do not use tools, service equipment, move aircraft, operate equipment, energize systems, start engines, or perform inspections, servicing, repairs, testing, or other maintenance.
  • Do not enter aircraft, cockpits, or restricted work areas as part of a FergAir referral. Flights, engine runs, and hands-on activities are outside the service.
  • If asked to participate in work, politely decline, explain that your visit is observation only, and contact FergAir. Leave if the visit cannot stay within these boundaries.

If you choose to participate anyway

Any hands-on participation violates FergAir’s observation-only policy and is outside the scope of the FergAir referral or service, even if the host invites you to participate. If you choose to touch aircraft, handle components, operate equipment, or perform or assist with maintenance, you do so on your own initiative and accept responsibility for your own actions. FergAir does not authorize, direct, or supervise that participation. To the extent permitted by applicable law, FergAir disclaims liability for injury, aircraft or other property damage, and other loss arising from that unauthorized participation. This provision does not waive rights or exclude liability that applicable law does not allow to be waived or excluded, including liability for FergAir’s own gross negligence or intentional misconduct where such liability cannot lawfully be excluded.

Before and during a visit

Tell the business that the request is for observation only and obtain its agreement before attending. The host must identify a staff member to escort you and explain approved observation areas, hazards, protective equipment, and visitor rules. Do not attend without the host’s permission. Follow safety instructions and any stricter facility restrictions. Leave an unsafe situation and report it to the host and FergAir. Never interpret FergAir’s recommendation as permission to enter a facility or handle an aircraft.

Independent host and visitor responsibilities

The aviation business decides whether to accept a visitor and controls its premises, access, staff, and safety arrangements. Visitors must follow this observation-only policy and the facility’s requirements. Aviation facilities may expose visitors to moving aircraft, vehicles, rotating machinery, noise, chemicals, trip hazards, and other risks even without hands-on activity. FergAir cannot monitor visits or guarantee a facility’s safety.

Agreement and service scope

Research checkout requires acceptance of these terms and submission of a city and travel radius before payment. FergAir clarifies incomplete briefs before starting work. Outreach support requires a separately agreed quote. The standard $59 research package covers five researched businesses in one city or agreed travel area, public contact routes where available, suggested contact roles, one tailored observation-only first message, and a follow-up plan. The report is emailed within five business days after payment and confirmation of the research brief, unless another delivery date is agreed before payment. One clarification or factual correction may be requested within seven days of delivery; a new location or expanded search is outside this standard scope. If fewer suitable businesses are found, the refund choices below apply. Outreach support is separately quoted with its business count, contact attempts, follow-ups, and timing. The research checkout saves your details, notifies FergAir, and opens Stripe for payment. A submitted form is not proof of payment or a confirmed visit. Outreach inquiries prepare an email for a separate quote. Before coordinating a visit, FergAir requires written confirmation from the participant and host that the visit is observation only. If a participant is under 18, a parent or guardian and the host must approve participation in writing before coordination proceeds.

Refunds

If completed research identifies no suitable aviation businesses within the agreed area, FergAir refunds 70% of the service fee and retains 30% for research work. For the $59 research service, the refund is $41.30 and the retained amount is $17.70. If FergAir cancels before starting any work, the fee is fully refunded.

If fewer businesses are found than agreed, the customer may accept a smaller report with an agreed partial refund, agree to expand the area, or stop the search and receive the 70% refund. Shop refusals or unanswered messages alone do not qualify a completed research report for a refund. Outreach quotes define refund terms for any other undelivered work before payment. Approved refunds return to the original payment method; provider processing times vary.

Legal rights

This policy defines the service and permitted participant conduct. It is not a promise that FergAir or any other person has no legal liability, and it does not waive rights or exclude duties that applicable law does not allow to be waived or excluded. Any separately agreed participation release must be provided before a visit; these terms do not replace the host’s visitor agreement.
